Basically, the amount of the owner’s and the builder’s share is declared by the reliable and experienced real estate of the region, but the basis of it is the estimation of the owner’s and the builder’s contribution, in the case of the owner, it is the approximate value of the property, and in the case of the builder, it is the approximate value of the building permit and construction costs until delivery. There are exceptions to this custom and rule, for example, in most areas of northern Tehran (areas 1-2-3-4), up to 5 useful residential floors, the owner’s share is 60% and the builder’s share is 40%, and the surplus is probably shared by the parties. Conversely, in case of taking excess classes, the ratios are determined by agreement.
